Extension Document for Scheduled Cruises

The following provisions apply in addition to the General Terms and Conditions of Seminarschiff Fluxservice GmbH.

§ 1 Tickets for Scheduled Cruises

  1. Before commencing the journey, a corresponding ticket must be purchased on the vessels or in the online shop.
  2. A valid ticket must be presented upon boarding the vessel and upon request. If no valid ticket is presented during a ticket inspection, the corresponding ticket must be purchased retroactively.
  3. For our scheduled cruises, § 312 g para. 2 sentence 1 no. 9 BGB (German Civil Code) applies. This stipulates that there is no right of withdrawal for services related to leisure activities if the contract provides for a specific date or period for the provision of the service.
  4. Issued tickets will not be refunded if the journey is not taken. In the case of a reduction in the number of persons for group tickets purchased in advance, no fare refunds will be made.

§ 2 Vouchers

  1. Vouchers of any kind are valid for all cruises offered by us at the time of redemption.
  2. An extension of vouchers is excluded.
  3. Each voucher is valid after purchase until December 31st of the following year.
  4. For our vouchers, the statutory right of withdrawal applies in accordance with the following provisions, provided you are a consumer* within the meaning of § 13 BGB:

Right of Withdrawal
Within 14 days after receiving the goods, you have the right to withdraw from the contract without giving any reasons. To withdraw from the contract, you must inform us, Seminarschiff Fluxservice GmbH, Blockdammweg 39-59, 10318 Berlin (Telephone: +49 176 3637 8047, E-mail address: info@seminarschiff.com) by e-mail. You may use the attached model withdrawal form for this purpose.

It is sufficient that you send the e-mail notifying us of the withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If the contract is withdrawn, we shall refund the payment made by you within 14 days.

§ 3 Changes to the Timetable

  1. In the event of severe weather events, circumstances of force majeure, such as in particular fire damage, flooding, strikes, lawful lockouts and diseases (including epidemics and pandemics), provided that a risk level of at least “moderate” is determined by the Robert Koch Institute, as well as in the event of technical defects for which we are not responsible and in the event of waterway or lock closures, we may abort the journey or change the route. Claims for refunds and reductions are excluded in such cases.
  2. We reserve the right to rebook the trip to another vessel.

§ 4 Withdrawal by Seminarschiff Fluxservice GmbH

  1. We have the right to withdraw from the contract for scheduled cruises if the minimum number of 6 passengers is not reached. In such cases, Seminarschiff Fluxservice GmbH will refund the ticket price. Any further claims are excluded.
  2. Should the cruise have to be cancelled due to actions caused by Seminarschiff Fluxservice GmbH’s own fault, the ticket price will be refunded. Any further claims are excluded.

§ 5 Liability

  1. We are liable for our obligations under the contract with the diligence of a prudent businessman*. Claims of the passenger* for damages are excluded. This does not apply to damages resulting from injury to life, body or health resulting from a breach of our duties or the duties of our legal representatives* or vicarious agents*.
  2. Should there be any disruptions or defects in our services, we will provide a remedy. The passenger* is obliged to inform us of the possibility of damage occurring if they notice such a situation.

§ 6 Loss or Damage of Brought Items

  1. We assume no liability for the loss or damage of personal items brought on board.
  2. Items left behind will be kept for a maximum of three months. These can be picked up personally during our opening hours at our mooring site Alt-Moabit.

§ 7 Liability of the Passenger for Damages

  1. The passenger* is liable for all damage caused by them to the vessel, furnishings, inventory, jetty facilities, etc.
  2. Parents* are liable for their children*.

§ 8 Miscellaneous

  1. Flammable, explosive, corrosive and malodorous substances will not be transported.
  2. The consumption of food and beverages brought on board the vessels is strictly prohibited.

*For better readability, the simultaneous use of masculine, feminine and diverse (m/f/d) language forms is avoided. All personal designations apply equally to all genders.
